| 1) Acceptance of terms |
Welcome to PornAndCash.com ,
PornAndCash provides its service to you, subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time at: http://www.pornandcash.com/TermsOfService.html. THIS AGREEMENT was made between PornAndCash.com (SITE we/us/our), and the Member/ Webmaster submitting this Application on the date the online Application Form is submitted to and approved by the SITE. |
| 2) Acceptable Use Policy |
PornAndCash will not tolerate any illegal or offensive methods of promotion of its websites. PornAndCash maintains the right to decide whether or not a promotion method is offensive.
Partner agree not to engage in the following activities in connection with marketing or promotion of the PornAndCash.com network: sending SPAM, instant messaging (i.e. IMs, ICQs, irc, AOL etc..); the direct or indirect promotion of child pornography (including visual depictions of sexual behavior involving children regardless of the age of the models), violence or other patently offensive or prohibited speech via images, tags, links or content of any kind; violations of copyright, trade or service mark or otherwise protected or patented materials, services, intellectual property or processes; artificial or false generation of hits, click-through or traffic to PornAndCash.com; misleading or defrauding the sponsor or any other affiliate; misrepresenting the cost, content or any other aspect of the service provided by PornAndCash.com Infringing partners will be terminated from the program, all illegal activities will be reported to the relevant agencies and all monies due will be held.
PornAndCash will not be held responsible for loss due to downtimes resulting from interruption of service, hardware or technical errors.
The partner’s use of PornAndCash.com and its zones constitutes the partner’s agreement to all terms, conditions, and notices as defined by PornAndCash. Failure to comply with any of the terms and conditions will lead to termination of the partner’s account. All monies due will be held and all future payment void. No warnings will be issued. A partner’s membership in the PornAndCash.com Revenue Program may be terminated at the sole discretion of PornAndCash. In such cases, all accounts owned by the partner in the PornAndCash program will be terminated and the partner will be blocked from the program indefinitely.
The partner will provide PornAndCash with a valid business/personnal information and a valid email address to be used for contact purposes.
PornAndCash must be able at all time to track hits and visits from websites used by the partner to promote PornAndCash.com.
Credit card fraud is closely monitored and will not be tolerated by PornAndCash. Every case of credit card fraud is reported to the companies concerned (Visa, Mastercard...) and the relevant authorities and government agencies. Legal action will be brought against any partner that will be deemed responsible for any sort of mechanism that falsely generates signups to the website. |
| 3) Your registration obligations |
You may only use our site if you are at least 18 years of age and can enter into binding contracts (our site is not available for use by minors). You are responsible for maintaining the secrecy of your passwords, login and account information. You will be financially accountable for all uses of our site by you and anyone using your password and login information. You may only use our site to make legitimate reservations or purchases. You may not use our site: to make any false, fraudulent or speculative reservation. We will use our reasonable commercial efforts to keep our site available on a 24-hour/7-day-a- week basis, subject to necessary scheduled downtime for maintenance, unscheduled maintenance and system outages. Your access to our site may not be uninterrupted or available at all times. We cannot promise that our site will be error-free, that defects or errors will be corrected or that our site or the servers that make it available are free from viruses or other harmful components. You will not use any device, software or routine that interferes or attempts to interfere with the normal operation of our site or take any action that imposes an unreasonable load on our computer equipment.
In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

| 4) Payement |
The earnings due to the partner are calculated by PornAndCash. The partner can see the amount owed to him in the statistics section of PornAndCash’s program.
All payments will be made in US Dollars. Payments will be made on a monthly schedule. With the exception of payments sent by wire transfers, payments are sent if minimum payout of $100 is reached. If not reached, the monies are carried over until minimum payout is reached. The minimum payout for wire transfer is $500.
Using incorrect payout names or providing the program with false information is considered fraud (especially if the partner is caught infringing the rules on another account). The account will be terminated and all payments stopped.
PornAndCash reserves the right to close ALL accounts operated by a partner caught cheating and void all payments. Fraudulent partners will be prosecuted to the fullest extent of the law.
In the even that the PornAndCash program is closed by PornAndCash, notification will be sent to the partner and all monies due will be paid and settled for all earnings generated up to that point in time. In the event the partner was found in violation of the terms and conditions all monies due will be held.
In the event that a partner wishes to close an account with PornAndCash, they must contact PornAndCash and request for the account to be closed. In this case, PornAndCash will pay for all earnings generated up to that point in time, except in cases where it is determined that the partner has cheated by violating these terms and conditions.

| 5) Force Majeure |
| Neither party will be held liable for, or will be considered to be in breach of or default under this Agreement on account of any delay or failure to perform as required by this Agreement as a result of any causes or conditions that are beyond such party's reasonable control and that such party is unable to overcome through the exercise of commercially reasonable diligence. If any force majeure event occurs, the affected party will give prompt written notice to the other party and will use commercially reasonable efforts to minimize the impact of the event. |

| Our site may contain links to other sites that we do not operate or control. We are not responsible for these other sites. We provide these links for your reference and convenience. We do not endorse the contents of these other sites. These links are not an indication of our association with the owners or operators of any of these other sites. You are free to access these other sites, but you do so at your own risk. |
| 7) Changes To These Terms And Conditions |
| Neither party will be held liable for, or will be considered to be in breach of or default under this Agreement on account of any delay or failure to perform as required by this Agreement as a result of any causes or conditions that are beyond such party's reasonable control and that such party is unable to overcome through the exercise of commercially reasonable diligence. If any force majeure event occurs, the affected party will give prompt written notice to the other party and will use commercially reasonable efforts to minimize the impact of the event. |
